# User Agreement — Elemental

## 1. Acceptance of terms

By accessing or using Elemental ("the app"), you agree to be bound by
this User Agreement and the accompanying Privacy Policy. If you do not
agree, do not use the app.

## 2. Acceptable use

You agree to use the app only for lawful purposes and in a way that does
not infringe the rights of, restrict, or inhibit anyone else's use of it.
You agree not to attempt to disrupt the app's operation, probe or scan it
for vulnerabilities beyond ordinary use, or use automated means to
extract data at a volume or rate that degrades service for other users.

## 3. No warranty on accuracy

Elemental is an educational chemistry reference. **Nothing in the app —**
including element data, molecule structures, reaction mechanisms,
functional-group classifications, suggested reaction pathways, or
protecting-group notes **— is warranted to be accurate, complete, or
current.** Reaction pathway suggestions in particular are generated by
matching functional groups against a reference catalog, not by full
atom-mapped retrosynthesis, and heuristic functional-group detection can
occasionally mislabel unusual structures. Always verify anything
consequential against a primary source (a textbook, a peer-reviewed
paper, or a qualified chemist) before relying on it.

## 4. No responsibility for your use of this information

We are not responsible for how you use information from this app,
including but not limited to academic work, laboratory or industrial
use, or any safety-related decision. You are solely responsible for
independently verifying any information before acting on it, especially
where personal safety, laboratory safety, or regulatory compliance is
involved.

## 5. Third-party services

The app relies on the following external services, each governed by its
own terms:

- **PubChem** (National Institutes of Health) — live molecule structure
  lookups. See [PubChem's terms](https://pubchem.ncbi.nlm.nih.gov/docs/about)
  and [NIH/NLM policies](https://www.nlm.nih.gov/web_policies.html).
- **RDKit.js** and **3Dmol.js**, loaded from public CDNs (cdnjs / unpkg) —
  open-source cheminformatics/visualization libraries that run in your
  browser to render structures.

The app does **not** use Google Analytics or any third-party analytics,
advertising, or tracking service. It does run first-party analytics that
we operate ourselves, which stores your IP address and sets a persistent
cookie to recognize returning visitors — see the Privacy Policy for full
details and for information on your consent choices.

We do not control and are not responsible for the availability, accuracy,
or content of these third-party services.

## 6. Intellectual property

The app's original content — its design, code, curated element/reaction/
functional-group data, and written descriptions — is owned by us unless
otherwise noted. You may use the app for personal, educational, or
research reference. You may not reproduce, redistribute, or repackage
substantial portions of the app's original content for commercial
purposes without permission.

## 7. "As is," no warranties

The app is provided **"as is" and "as available," without warranties of
any kind**, express or implied, including but not limited to warranties
of merchantability, fitness for a particular purpose, non-infringement,
or that the app will be uninterrupted, error-free, or secure.

## 8. Availability and changes

We may modify, suspend, or discontinue any part of the app at any time,
without notice. We may also update this agreement as the app changes;
material changes will be reflected by updating the "Last updated" date
above. Continued use after changes constitutes acceptance of the revised
agreement.

## 9. Limitation of liability

To the fullest extent permitted by law, we are not liable for any
indirect, incidental, special, consequential, or punitive damages, or any
loss of data, use, or goodwill, arising from your use of or inability to
use the app — including damages arising from reliance on any chemical,
reaction, or safety-adjacent information the app provides.

## 10. Indemnification

You agree to indemnify and hold us harmless from any claim, liability,
loss, or expense (including reasonable legal fees) arising from your use
of the app, your violation of this agreement, or your violation of any
third party's rights.

## 11. Governing law

This agreement is governed by the laws of the State of Alabama, United
States, without regard to conflict-of-law principles. Any dispute arising
from this agreement or your use of the app will be subject to the
exclusive jurisdiction of the courts located in Alabama.
